ORDER NO. 894

Whereas concerns on various security issues have been brought to the notice of the undersigned which leads to apprehension that terrorists/anti-social elements may seek hideouts in areas within the District and there is likelihood of breach of peace and disturbance of public tranquility and also there is grave danger to human life and safety and injury to public property on that account.

2)            And whereas it is necessary that some checks should be put on landlord/tenants, internet cafes etc. so that terrorists/anti-social elements in the guise of tenants may not cause explosion riots, shoot outs, affray etc. and that immediate action is necessary for the prevention of the same.

3)            Now, therefore, in exercise of the powers conferred upon me by Section 144 of the Criminal Procedure Code, 1973 I, Rupesh Kumar Thakur, Deputy Commissioner, South Andaman, do hereby order that

a)            no landlord/owner/person of any house/property which falls under the jurisdiction of area of Police Stations in the District, shall let/sublet/rent out any accommodation to any person unless and until he has furnished the particulars of the tenant(s) in a specified Performa to the Station House Officer of the Police Station concerned. All persons who intend to take accommodation on rent shall inform in writing in this regard to the Station House Officer concerned in whose jurisdiction the premises falls. The persons dealing in property business shall also inform in writing to the Station House Officer concerned in whose jurisdiction the premises/property falls about the particulars of the said tenants.

b)            All Cyber-café owners are directed to keep the record of all such persons who are visiting their Café and using internet.

c)             Similarly, tailors are strictly prohibited from stitching any police or other para military uniforms unless the proper identity of the customer is established.

4)            The order shall come into force with effect from 01-07-2013 and shall be effective for a period of 60 days up to 29-08-2013 (both days inclusive) unless withdrawn earlier.

5)            Any person contravening this order shall be punishable under section 188 of the Indian Panel Code.

6)            As the notice cannot be served individually on all concerned the order is passed ex-parte. It shall be published for the information of the public through the press and by affixing copies on the notice boards of the DC Office, SP Office, South Andaman District, SDM Office, South Andaman, all Tehsil Offices of the District, all police stations in the District and Notice boards of Port Blair Municipal Council, Zilla Parishad, South Andaman and all Gram Panchayats in the District.
